Employment law advice for pharmacies and drugstores

Injections, variable pay, rotas, deductions and succession require policies suited to actual store operations, beyond generic templates.

General information. Classification, amounts and measures depend on the activities, records and rules in force for each establishment.

The most sensitive issue

Habitual administration of injections may lead to a medium-level allowance

Annex 14 of NR-15 classifies work involving permanent contact in human healthcare establishments at the medium level. The TST has precedents applying this rule to drugstore employees who habitually administer injections.

Tese Jurídica Prevalecente nº 19 of the TRT da 3ª Região follows the same approach for pharmacies and drugstores. It is regional, but is not the only reference on the subject.

The allowance is not automatic: actual duties, habitual performance, protective measures and technical or expert assessment must be considered.

Check the operation

When an employment law review is commonly useful

Identifying these situations does not determine the outcome, but helps select the documents and professionals needed for the assessment.

  • A drugstore offering administration of injectable medicines.
  • A store paying commission, performance awards or campaign incentives by product category.
  • An establishment with extended opening hours, a 24-hour operation or a 12x36 rota.
  • A pharmacy or drugstore opening on Sundays and public holidays.
  • A business checking personal belongings or making deductions for cash and stock discrepancies.
  • A chain needing to coordinate pharmacist presence, working hours and opening times.
  • A business owner intending to buy, sell or take over an establishment.
  • A company facing a claim, inspection or proceedings by the Ministério Público do Trabalho.

Pharmacy retail overview

Six issues that may arise in the same claim

The same worker may serve customers, sell, earn commission, work a rota and take part in pharmaceutical services.

01

Actual duties and habitual performance

Injections and biological agents

The TST has precedents recognising a medium-level unhealthy-work allowance where employees habitually administer injections. Classification is not automatic and requires assessment of duties and working conditions.

02

Nature of the payment

Commission and performance awards

Commission forms part of salary. Prêmios have their own rules under the CLT and require performance above what is ordinarily expected. The label and frequency alone do not determine classification.

03

An open store, a protected team

Hours and rotas

A 12x36 rota, night-work allowance, breaks, Sundays and public holidays must comply with the instruments and rules in force for the place and period.

04

Limits on managerial authority

Deductions and checks

Cash or stock discrepancies and damage do not authorise automatic deductions. Checks of belongings must not violate privacy or dignity, or expose workers to humiliation.

05

Obligation and evidential strategy

Time records

Article 74, §2º, of the CLT requires records in establishments with more than twenty workers. Below that threshold, voluntary monitoring can still organise working time and evidence.

06

Liabilities follow the operation

Purchase and succession

A change of ownership does not interrupt contracts and may transfer employment liabilities to the successor under Articles 448 and 448-A of the CLT.

Multiplier effect

An incorrect practice may recur. So may a well-implemented correction.

Assessment looks for patterns before addressing individual documents.

Injections and occupational health and safety records

Pharmacist cover

Hours, replacements and presence aligned with actual store opening times under applicable legislation.

Deductions and internal procedures

Policies on cash, stock, damage, targets, checks of personal belongings and handling incidents.

Purchase, sale or expansion

Contracts, employees, proceedings, contribution payments, reports and contingencies before changing the operation.

Payroll and pay

Commission, performance awards and overtime require different calculations

Correctly identifying the nature of a payment is as important as calculating its amount.

Commission

It forms part of salary and requires consequential entitlements to be addressed. Variable pay has its own overtime rule according to the activity performed during overtime.

Performance awards

The CLT links them to performance above what is ordinarily expected. Calling commission a prêmio does not change the payment's actual nature.

Night-work allowance

Hours, extensions, the reduced statutory night hour and rotas must be checked alongside collective rules.

Sundays and public holidays

Statutory and administrative rules may change. Collective instruments and conditions applicable to the place and date remain relevant.

Common cases

Situations requiring attention

  • A claim for an unhealthy-work allowance for habitually administering injections.
  • Commission and performance award shortfalls and consequential entitlements.
  • Overtime or night-work allowance in a store without consistent records.
  • A dispute about a 12x36 rota, Sundays or public holidays.
  • Reimbursement of deductions for cash, stock, breakage or damage.
  • Non-pecuniary harm associated with searches, targets or treatment exposing workers to humiliation.
  • Acquisition of an establishment with previous contracts and liabilities.
  • An inspection, infringement notice or collective proceedings.

Frequently asked questions

Employment law in pharmacies and drugstores

Can administering injections give rise to an unhealthy-work allowance?

Yes. Annex 14 of NR-15 classifies certain work involving permanent contact in human healthcare establishments at the medium level. The TST has precedents recognising the medium-level allowance where injections are administered habitually. The conclusion depends on actual duties and technical or expert assessment; it does not arise solely because the store offers the service.

Does the Minas Gerais regional court's position apply throughout Brazil?

Tese Jurídica Prevalecente nº 19 belongs to the TRT da 3ª Região. There are also TST precedents on habitual administration of injections in drugstores. Each case nevertheless depends on evidence of duties, conditions and the approach applicable to it.

Are commission and performance awards the same?

No. Commission forms part of salary under the CLT. A prêmio has its own statutory definition: a discretionary award for performance above what is ordinarily expected. The label on a receipt does not, by itself, override how the payment operates in practice.

How is overtime calculated for commission earners?

Súmula 340 and TST case law provide specific treatment of variable pay when overtime is spent on commission-generating activity. If overtime involves duties that generate no commission, the assessment may differ.

Must a store with up to twenty employees keep time records?

Article 74, §2º, of the CLT requires records in establishments with more than twenty workers. Below that threshold, monitoring may be adopted to organise rotas and produce evidence, using a system consistent with reality.

Can drugstores use a 12x36 rota?

It can be established by a written individual agreement, collective agreement or collective convention under Article 59-A of the CLT. Breaks, night-work allowance, public holidays and applicable collective clauses must also be examined.

What about Sundays and public holidays?

Rules vary with the day, activity, municipal legislation, current ministerial order and collective instrument. In July 2026, the Brazilian Ministry of Labour published regulations listing pharmacies among the activities excepted for public holidays, without removing other employment and collective conditions that must be observed.

Can cash or stock discrepancies be deducted?

Article 462 of the CLT restricts wage deductions. Where an employee causes damage, deductions depend on statutory conditions, including prior agreement or intent according to the circumstances. Collective rules and actual facts must also be checked.

Can the company inspect bags and personal belongings?

Case law distinguishes general visual checks without physical contact from intimate, selective, humiliating or exposing procedures. Even a written policy must respect dignity, privacy and proportionality in practice.

Must a pharmacist be present throughout opening hours?

Lei nº 13.021/2014 requires a pharmacist to be present throughout opening hours. Employment arrangements must align hours, replacements and records with actual operations, distinguishing legal advice from the duties of the professional council and health surveillance authorities.

Does buying a drugstore transfer employment liabilities?

Employment succession may arise. Articles 448 and 448-A of the CLT preserve contracts and make the successor liable for obligations, including earlier ones, subject to the rules on fraud and the predecessor's liability. The transaction structure should be audited.

Can services be provided outside Brasília?

Yes. Assessment, meetings and documentary review can take place online for companies throughout Brazil. In-person services are available in Ceilândia Sul, Brasília/DF, and visits can be considered according to need.

WhatsApp messages can be received in different languages. Telephone calls are available in Portuguese, English and Spanish.
