Understand the benefit

What is rural maternity benefit?

It is the social security benefit payable for time away from work due to childbirth, adoption, court-ordered custody for adoption or miscarriage or lawful abortion. For a special insured person, the amount is generallyone minimum wage per month for 120 days.

Following ADIs 2.110 and 2.111 and Normative Instruction PRES/INSS No 188/2025, maternity benefit became exempt from a qualifying contribution period for all categories. This does not remove the need to prove insured status or assess rural activity.

Documentation must show who carried out the activity, when and how the work contributed to family subsistence. The body of evidence matters more than any single document.

Who may need this assessment

Identifying with one of these groups does not automatically establish entitlement, but helps identify the category and appropriate documents.

  • A family farmer who grows crops or raises animals with her family.
  • An artisanal fisher, shellfish gatherer, forest product gatherer, rubber tapper or riverside community member.
  • A rural day worker or boia-fria, even without formal registration.
  • An Indigenous woman engaged in rural activity according to her community's organisation.
  • A worker who helps her partner, parents or family on the land, even without documents in her own name.
  • A person who has adopted a child or obtained court-ordered custody for adoption.

Documents that may help

The list is not exhaustive. Each document's usefulness depends on the period, social security category and consistency with the account presented.

Personal documents and evidence of the qualifying event

Identification, CPF and birth certificate. For adoption or custody, the certificate or corresponding court order.

Special insured person's self-declaration

An account of rural activity submitted to the INSS, consistent with dates, places, family group and other evidence.

CAF, former DAP and rural registers

The Family Farming Register, INCRA, ITR, rural CadÚnico and other public records may help demonstrate the activity.

Invoices and production records

Producer's invoice book, delivery notes, evidence of sales at markets or cooperatives and trading records.

Land-related agreements

Leases, agricultural partnerships, loans for use, grants of use or other documents indicating the property's exploitation.

Evidence of artisanal fishing

Activity registration, evidence of fish sales and documents from a fishing community organisation or association, as applicable.

Family group documents

Papers in a partner's, parent's or other member's name may form part of the evidence, according to family circumstances.

Medical certificate, where needed

Used where leave begins up to 28 days before childbirth or in medical circumstances covered by the benefit rules.

Common cases

Situations that often need attention

  • An application was refused for lack of documents on rural activity.
  • The refusal cited a qualifying contribution period, although current rules have removed that requirement.
  • The birth, adoption or custody occurred less than five years ago and no application has yet been made.
  • The self-declaration contains discrepancies or was submitted without supporting documents.
  • The rural evidence is in a partner's or other family members' names.
  • There are urban work periods or other CNIS details requiring context.
  • A request for evidence has been issued in Meu INSS and it is unclear what to submit.
  • The application is pending or was refused, and an appeal, review or court action needs assessing.

Transparency

What may lead to refusal

Identifying weaknesses before applying helps avoid inconsistencies and respond properly to requests.

  • Inconsistencies between the self-declaration and documents submitted.
  • Insufficient evidence of insured status on the date of childbirth, adoption or custody.
  • Urban employment or outside activities without adequate explanation of family circumstances.
  • Bank or registration documents in a third party's name where the INSS requires the beneficiary to be the holder.
  • A custody order that does not expressly state its adoption purpose.
  • A missed deadline for complying with a request or submitting an additional document.

No single item determines the outcome. The INSS's stated reason and the body of evidence must be assessed in the individual case.

Frequently asked questions

Questions about rural maternity benefit

Must a special insured person have paid monthly INSS contributions?

Not necessarily. A special insured person may receive the benefit without monthly payments, but must demonstrate insured status and rural activity. The qualifying contribution period for maternity benefit was waived for all categories following ADIs 2.110 and 2.111 and Normative Instruction PRES/INSS No 188/2025.

Can the INSS still request documents about rural work?

Yes. Waiving the qualifying contribution period does not remove the assessment of insured status. The INSS may request a self-declaration, rural documents, public records and other evidence showing activity at the time of the qualifying event.

How long does it last and how much is paid?

As a rule, it lasts 120 days. For a special insured person without voluntary contributions, the amount is one minimum wage per month. If voluntary contributions were paid, the calculation method may differ.

My child was born some time ago. Can I still apply?

As a rule, an application can be made within five years of birth, adoption, custody for adoption or miscarriage or lawful abortion. The exact date must be checked in the individual case.

Can payment begin before childbirth?

The benefit may start up to 28 days before childbirth where leave is taken and a specific medical certificate is provided. It may also start on the date of childbirth, evidenced by the corresponding certificate.

I am a rural day worker or boia-fria. Could I qualify?

You may qualify, but the social security category must be correctly identified and evidence of activity gathered. Lack of a formally registered employment record does not, on its own, conclude the assessment.

The documents are in my partner's or parents' names. Can they help?

They may help. Documents of family group members may provide initial documentary evidence, provided they are consistent with the activity, period and family circumstances presented.

What about miscarriage, lawful abortion or stillbirth?

For miscarriage or lawful abortion, the benefit is payable for 14 days, supported by medical evidence. For stillbirth, it lasts 120 days.

Does adoption also qualify for maternity benefit?

Yes. Adopting a child or obtaining court-ordered custody for adoption may qualify for 120 days of benefit, subject to legal conditions and the documents required by the INSS.

What happens if the INSS takes too long to assess the application?

Law No 15.415/2026 set a deadline of up to 30 days to award maternity benefit paid directly by Brazil's social security system and provides for an automatic provisional award if that deadline is missed, without preventing subsequent assessment of the requirements.
