Meat processing and logistics in Triângulo Mineiro: from the cold production line to hours on the road

Production, cold rooms, dispatch, the yard and transport form an integrated operation, but each role involves different rules and evidence. The assessment must bring together temperature, breaks, tracking, working hours and health.

General legal information. Any entitlement depends on the facts, records, collective rules and, where applicable, expert evidence.

Work away from the premises

Tracking and route planning may show that monitoring is possible

Being away from the employer's premises does not, in itself, mean working without oversight of working hours.

Article 62, I, of the CLT covers work away from the premises that is incompatible with setting working hours. This is an exceptional classification based on the actual situation, rather than a contractual entry alone.

Tracking devices, apps, telephones, check-ins, delivery windows, receipts and contact with the control centre may indicate the ability to monitor the daily routine. None of these elements, on its own, proves the entire working day.

For loading, unloading, waiting and overnight stays, the role, dates, applicable legal regime, collective agreements and actual monitoring must be considered. A chronological reconstruction avoids generalisations.

Situations we assess

Who may need an integrated assessment

Advice for employees in production and the logistics chain, without confusing the rules specific to each activity.

  • Slaughtering, cutting, deboning, packaging and cleaning
  • Cold rooms, dispatch and handling refrigerated products
  • Drivers of articulated lorries, heavy and medium rigid lorries and light vehicles
  • Assistants, goods checkers and loading operators
  • Yard, weighbridge, maintenance and utilities
  • Outsourced employees at the plant or on the route
  • Workers subject to tracking and route planning
  • People with an accident, absence from work or diagnosis related to work

Areas of assessment

Issues that may need checking

The list helps identify relevant issues, but cannot establish that a particular payment is due without examining the case.

Work away from the premises

Whether monitoring is possible, routes, instructions and communications are assessed against article 62 of the CLT.

Tracking and evidence

Logs, apps, tolls, fuel records and receipts may help reconstruct working hours.

Loading, unloading and waiting

The classification and payment of this time depend on the occupational category, period, collective agreements and applicable legislation.

Cold exposure breaks

Production and dispatch may require an assessment under article 253, depending on temperature and continuity of exposure.

NR-36 and ergonomics

Breaks, work pace, rotation and production line organisation must be checked in practice.

Accidents and health

Causation, incapacity, the CAT accident notification, benefits and protected employment are assessed without presumptions based on the sector.

Breaks and rest

Meal breaks, rest between working days and specific rest periods require a reliable chronology.

Outsourcing

The service provider, client company and oversight affect liability for amounts found to be due.

Would you like to organise your documents before deciding?

Initial advice identifies the facts, periods and records that need checking.

Explain my situation

Employment time limits

The contract end date needs checking

As a general rule, the Brazilian Constitution allows two years after the contract ends to bring proceedings, and limits recovery to entitlements from the five years before the claim is filed.

2 years

General period from the end of employment for bringing an employment claim.

5 years

General reach of entitlements preceding the claim, subject to the particular circumstances.

Accidents and illnesses may have specific limitation period starting points linked to awareness of the injury. Dates of absence, benefits and diagnosis must be preserved.

Organising documents

What helps with assessment

You do not need every document at first contact. The aim is to identify what exists and what will need to be requested.

Time records and rotas

Timecards, time record summaries, shifts, days off, break monitoring and access records.

Routes and tracking

GPS reports, telematics, apps, instructions, delivery windows, tolls and fuel records.

Loading and delivery

Transport documents, delivery receipt stubs, invoices and records of loading, unloading and queuing.

Contract and payslips

Role, salary, supplements, daily allowances, commissions and method of payment.

Health and safety

ASO occupational health certificates, CAT accident notifications, examinations, the PGR risk management programme, expert reports, PPE, temperature and ergonomics, where available.

Collective agreements

Agreements applicable to the occupational category, geographical area and period.

Transparency

What does not establish an entitlement by itself

The activity, sector or an isolated impression cannot replace assessment of facts and evidence.

  • A tracker alone does not prove all the hours claimed.
  • A contractual entry describing work away from the premises does not conclude the assessment where monitoring tools were available.
  • Loading, unloading and waiting time is not classified identically for every role and period.
  • Working in dispatch does not automatically prove continuous cold exposure.
  • Production and transport have their own rules; an integrated operation does not eliminate these differences.

Frequently asked questions

Questions before first contact

General answers for guidance. Conclusions depend on the records and circumstances of each contract.

Does a driver whose vehicle has a tracker always qualify for overtime pay?

Not automatically. Tracking devices, mobile phones, route planning and check-ins may show that monitoring is possible, but the actual hours worked and the evidence as a whole must be examined.

Does working away from the employer's premises exclude working time monitoring?

Only where the activity is genuinely incompatible with setting and monitoring working hours. Article 62, I, of the CLT is an exception; technological tools and operational routines may affect the assessment.

Does time spent queuing, loading or unloading count as working time?

The classification depends on the role, the period of employment, applicable legislation, collective agreements and the degree of monitoring. Logs, receipts and records must be analysed before reaching a conclusion.

Can dispatch workers qualify for cold exposure breaks?

An entitlement may arise for continuous work in an artificially cold environment meeting the requirements of article 253 and Súmula 438. Occasional entry does not lead to the same conclusion.

Are NR-36 breaks added to cold exposure breaks?

Not mechanically. Where the qualifying circumstances occur simultaneously, NR-36 prohibits combining the breaks. Their timing, location and purpose must be reconstructed.

Can an accident on a delivery route give rise to protected employment?

There may be employment and social security consequences, but the circumstances, causal link, benefit, incapacity and dates must be assessed in the individual case.

WhatsApp messages can be received in different languages. Telephone calls are available in Portuguese, English and Spanish.
