Meat processing: breaks, cold environments and health require assessment of actual working practices

Cutting, packing, dispatch, cold rooms, cleaning and maintenance involve different temperatures and paces. Time records, break controls, health documents and evidence of operations should be assessed together.

General legal information. Any entitlement depends on the facts, records, collective rules and, where applicable, expert evidence.

Thermal recovery

A break may be due even outside the cold room

The department's name is not the only criterion. Temperature, continuity and conditions similar to a cold room must be demonstrated.

Article 253 of the CLT provides twenty minutes' rest after one hour and forty minutes of continuous work for employees covered by the rule, counting the break as working time.

Súmula 438 of the TST also recognises the break for employees performing continuous work in artificially cold environments, even outside cold rooms. Temperature and climate zone form part of the classification.

In 2025, the full TST held in Tema Repetitivo 80 that absence of this break in cold rooms or similarly artificially cold environments gives entitlement to an unhealthy-work allowance even with EPI. The ruling does not dispense with evidence that the environment and duties meet its requirements.

Situations we assess

Activities covered by the sector assessment

This page covers different meat processing and agro-industrial roles without assuming that all share the same thermal conditions.

  • Slaughter, deboning, cutting, offal and packing
  • Labelling, dispatch and storage cold rooms
  • Industrial cleaning and support areas
  • Mechanical, electrical and utilities maintenance
  • Receiving, loading platform and internal handling
  • Refrigerated logistics and forklift operation
  • Outsourced cleaning, maintenance and transport
  • Other agro-industrial operations with artificially cold environments

Areas of assessment

Issues that may need checking

The list helps identify relevant issues, but cannot establish that a particular payment is due without examining the case.

Thermal recovery break

Temperature, continuity, exposure time and actual provision are compared with Article 253 and Súmula 438.

NR-36 breaks

The regulation's table, actual working time and break distribution need checking against the real working day.

Cold-related unhealthy work

Environmental classification, protection, breaks and the TST's repetitive appeal ruling require technical and documentary evidence.

Ergonomics and repetitive work

Pace, task rotation, furniture, tools and muscular demands matter for prevention and any occupational causal link.

Accident and employment protection

Social security benefits, CAT, diagnosis and connection to work affect employment protection and other consequences.

Changing and cleaning

Compulsory time under company control may form part of working time assessment, depending on the place and circumstances.

Meal break

Entries, duration and the actual ability to leave the workstation should be compared.

Outsourcing

The service provider, commissioning party, monitoring and default affect liability for recognised entitlements.

Would you like to organise your documents before deciding?

Initial advice identifies the facts, periods and records that need checking.

Employment time limits

The contract end date needs checking

As a general rule, the Brazilian Constitution allows two years after the contract ends to bring proceedings, and limits recovery to entitlements from the five years before the claim is filed.

2 years

General period from the end of employment for bringing an employment claim.

5 years

General reach of entitlements preceding the claim, subject to the particular circumstances.

For accidents or occupational disease, the limitation starting point may involve unequivocal knowledge of the injury and its consequences. The dismissal date should not be assessed in isolation.

Organising documents

What helps with assessment

You do not need every document at first contact. The aim is to identify what exists and what will need to be requested.

Time records and break controls

Hours, entries, rotas and specific records of thermal and psychophysiological breaks.

Employment record, contract and payslips

Role, department, period, allowances and working time payments.

Health records

ASOs, examinations, certificates, CAT, patient records and benefit history where relevant to the case.

Safety records

PGR, reports, temperature, ergonomics, EPI records and training where available.

Collective rules

Conventions and agreements applicable to the company, occupational category and period.

Operational description

Department, pace, replacements, rest location, temperature and duties actually performed.

Transparency

What does not establish an entitlement by itself

The activity, sector or an isolated impression cannot replace assessment of facts and evidence.

  • Working in meat processing does not by itself prove qualifying exposure to cold.
  • An NR-36 break should not be mechanically added to a thermal recovery break without assessing overlap and purpose.
  • Pain without diagnosis and causal assessment does not automatically establish occupational disease.
  • Formal break records matter, but must be assessed alongside actual operations.
  • EPI, temperature, exposure time and provision of breaks are separate elements of assessment.

Frequently asked questions

Questions before first contact

General answers for guidance. Conclusions depend on the records and circumstances of each contract.

Must I work inside a cold room to qualify for a thermal recovery break?

Not necessarily. Súmula 438 of the TST extends the break under Article 253 of the CLT to continuous work in an artificially cold environment, even outside a cold room. Temperature, continuity of exposure, climate zone and actual duties must be checked.

What break does Article 253 of the CLT provide?

In the circumstances covered, it provides twenty minutes' rest after one hour and forty minutes of continuous work, counting the break as working time. Application depends on the statutory requirements and Súmula 438.

Are NR-36 breaks always sixty minutes?

The regulation should not be reduced to that statement. NR-36 contains a table linked to actual daily working time and rules on distribution. How psychophysiological breaks interact with other compulsory breaks must also be checked in each case.

Does a recorded break settle the issue?

The record matters, but can be compared with actual line organisation, availability of replacement staff, entries and witness evidence. Conclusions depend on all the evidence.

Can absence of a thermal recovery break affect an unhealthy-work allowance?

In 2025, the TST held in Tema Repetitivo 80 that work in cold rooms or similarly artificially cold environments without the Article 253 break gives entitlement to an unhealthy-work allowance, even where EPI is provided. The environment and duties must still be shown to fall within the ruling.

Is shoulder, wrist or back pain an occupational disease?

Pain alone does not establish this. Diagnosis, medical history, pace, repetition, ergonomics and a link to the activity need assessment.

I was dismissed after a period of absence. Do I have protected employment?

Article 118 of Lei nº 8.213/1991 provides twelve months' employment protection after work-related temporary incapacity benefit ends. Case law recognises other circumstances where occupational disease is identified later, but each case requires individual assessment.
