Ports and industry in Greater Vitória: rights that require technical evidence

Ports, terminals, steelmaking, pulp, logistics and contractors have their own working hours, supplements and risks. Advice starts with the actual activity, rotas and collective agreements for the period.

General legal information. Any entitlement depends on the facts, records, collective rules and, where applicable, expert evidence.

Port work

The casual dockworker's risk supplement depends on specific conditions

Tema 222 of the STF protects equal treatment, but does not make the supplement automatic for every activity carried out near a port.

Law No. 4.860/1965 governs the risk supplement in certain port activities. Its application considers where the work is performed, the activity, the operating regime and the statutory conditions.

In RE 597.124, Tema 222, Brazil's Supremo Tribunal Federal held that whenever the supplement is paid to permanent employees it is also due, on the same terms, to casual dockworkers.

The ruling itself requires a comparison of the actual circumstances. OGMO labour management body receipts, rotas, operators, terminals, collective agreements and payments to permanent employees help establish whether the requirements are met.

Situations we assess

Port and industrial activities in the region

The focus is by sector. Each activity has its own documents, risks and rules.

  • Casual dockworkers allocated by the OGMO labour management body
  • Terminals, port operators and cargo handling
  • Steelmaking, rolling and industrial maintenance
  • Pelletising, yards and ore logistics
  • Pulp, storage and the logistics corridor
  • Dimension stone and mineral processing
  • Outsourced maintenance, cleaning and logistics
  • Construction and assembly during industrial shutdowns

Areas of assessment

Issues that may need checking

The list helps identify relevant issues, but cannot establish that a particular payment is due without examining the case.

Port risk supplement

The special law and Tema 222 require checks on activity, facility, period, comparable payments and collective agreements.

Rotating shifts

Alternating rotas may attract the specific constitutional working time regime, subject to valid collective bargaining.

Heat, noise and industrial agents

Supplements and preventive measures depend on assessment of actual conditions, applicable limits and protective effectiveness.

Dangerous working conditions pay

Flammables, electricity and other risk areas require regulatory classification and evidence of exposure for the Brazilian periculosidade supplement.

Breaks and rest

Double shifts, meal breaks and rest between working days must be compared with records and the actual rota.

Outsourcing

The contract, oversight and non-payment affect possible subsidiary liability of the client company.

Accidents and occupational disease

Hearing loss, musculoskeletal problems and dust exposure require a diagnosis and analysis of the causal link with work.

Collective agreements

Agreements may regulate working hours, payments and procedures specific to the sector.

Would you like to organise your documents before deciding?

Initial advice identifies the facts, periods and records that need checking.

Explain my situation

Employment time limits

The contract end date needs checking

As a general rule, the Brazilian Constitution allows two years after the contract ends to bring proceedings, and limits recovery to entitlements from the five years before the claim is filed.

2 years

General period from the end of employment for bringing an employment claim.

5 years

General reach of entitlements preceding the claim, subject to the particular circumstances.

For casual dockworkers, limitation periods and their starting points must not be treated simply as contract termination. The rota history and OGMO registration must be examined.

Organising documents

What helps with assessment

You do not need every document at first contact. The aim is to identify what exists and what will need to be requested.

OGMO rotas and receipts

They identify dates, operators, terminals, roles and payments made to the casual dockworker.

Employment record book, contracts and payslips

They record employment, role, remuneration, employers and supplements received.

Timecards and rotas

They help reconstruct rotating shifts, working hours and breaks.

Collective agreements

Agreements applicable to the occupational category, operator and period.

Health documents

ASO occupational health certificates, examinations, CAT accident notifications, medical certificates and social security history in cases of illness or accident.

Activity records

Description of the workstation, location, equipment and work communications preserved lawfully.

Transparency

What does not establish an entitlement by itself

The activity, sector or an isolated impression cannot replace assessment of facts and evidence.

  • Working near a port is not enough to receive the risk supplement under Law No. 4.860/1965.
  • A fixed shift is not a rotating shift simply because the work takes place at night.
  • An industrial environment does not automatically qualify for unhealthy or dangerous working conditions pay.
  • The client company's liability depends on the legal context and evidence in the case.
  • Illness or hearing loss requires a diagnosis and assessment of occupational causation.

Frequently asked questions

Questions before first contact

General answers for guidance. Conclusions depend on the records and circumstances of each contract.

Do casual dockworkers always receive the port risk supplement?

Not automatically. In Tema 222, the STF held that it is due to casual dockworkers (trabalhadores avulsos) on the same terms when paid to permanent employees and when the specific statutory conditions are met. Rotas, location, period, port regime and payments must be checked.

What constitutes continuous rotating shift work?

Alternating hours covering different parts of the day may constitute this regime. The Constitution provides for a six-hour working day, subject to collective bargaining. The actual rota and collective agreement for the period are essential to the assessment.

Can the port risk supplement be combined with unhealthy working conditions pay?

Law No. 4.860/1965 treats the port risk supplement as specific remuneration for port risks and prohibits combining it with the CLT supplements for unhealthy or dangerous working conditions. The first step is to confirm whether the special law applies to the activity.

I worked for a contractor. Is the client company liable?

Subsidiary liability may be considered according to the engagement, period, nature of the client and evidence of non-payment. Súmula 331 of the TST is a reference, but the outcome is not automatic.

Can hearing loss be an occupational disease?

Yes, where there is a diagnosis and a causal link with occupational exposure. Medical history, hearing tests, a description of the environment and protective measures are relevant.

Do I have to travel to Brasília for advice?

No. Initial advice can be provided online and documents sent digitally. Participation in procedural hearings and other steps depends on the court and the case.
