Meat processing in western Paraná: breaks, pace and health need checking against actual line conditions

Slaughter, cutting, packing, cleaning, cold rooms, dispatch and maintenance involve different risks and practices. Break records, pace, temperature, rotation and absences must be compared with practice.

General legal information. Any entitlement depends on the facts, records, collective rules and, where applicable, expert evidence.

Assessment of records, working hours and occupational health

Breaks and pace

The NR-36 table must be applied to actual working time

There is no single break total for every shift. Hours, distribution, overlap and actual line conditions affect the assessment.

NR-36 establishes psychophysiological breaks according to actual daily working time. Its table sets different totals and distribution rules, so reducing every working day to sixty minutes can be misleading.

Where continuous cold exposure also falls within Article 253 of the CLT, whether breaks occurred simultaneously must be checked. NR-36 itself prevents mechanical accumulation when the situations overlap.

The regulation also prohibits increasing individual pace to compensate for breaks. Production reports, videos, messages, rotation, replacements and witnesses may help reconstruct actual work organisation.

Situations we assess

Departments and relationships that may need checking

Assessment covers poultry, pig processing and other agro-industrial plants, respecting differences between roles and contracts.

  • Slaughter, evisceration, cutting, deboning and packing
  • Cold rooms, tunnels, dispatch and refrigerated logistics
  • Industrial cleaning and sanitation
  • Maintenance, utilities, boilers and refrigeration
  • Quality control and production support
  • Employees of cooperatives, meat processing companies and outsourced providers
  • Integrated producers with questions about civil contracts
  • Workers with absences, CAT or a musculoskeletal diagnosis

Areas of assessment

Issues that may need checking

The list helps identify relevant issues, but cannot establish that a particular payment is due without examining the case.

NR-36 breaks

Actual time, the table total, distribution and real provision must be compared.

Thermal recovery break

Temperature, continuity and an environment similar to a cold room affect application of Article 253 and Súmula 438.

Pace and rotation

Pace, targets, replacements and task rotation matter for ergonomics and prevention.

Unhealthy work

Cold and other agents require statutory classification, exposure assessment and, where appropriate, expert evidence.

Occupational disease

Diagnosis, causation, incapacity and preventive measures are examined without assuming causation from the sector.

Agro-industrial integration

The civil relationship under Lei nº 13.288/2016 must be distinguished from employment and situations outside the statutory model.

Working hours and breaks

Time records, shifts, compulsory changing, cleaning and meals must be compared with actual practices.

Outsourcing

The service provider, commissioning party, monitoring and default affect liability for recognised entitlements.

Would you like to organise your documents before deciding?

Initial advice identifies the facts, periods and records that need checking.

Explain my situation

Employment time limits

The contract end date needs checking

As a general rule, the Brazilian Constitution allows two years after the contract ends to bring proceedings, and limits recovery to entitlements from the five years before the claim is filed.

2 years

General period from the end of employment for bringing an employment claim.

5 years

General reach of entitlements preceding the claim, subject to the particular circumstances.

For occupational disease, the limitation starting point may involve unequivocal knowledge of the injury and its consequences. Dismissal, benefits and diagnosis must be considered together.

Organising documents

What helps with assessment

You do not need every document at first contact. The aim is to identify what exists and what will need to be requested.

Time records and break controls

Time cards, record extracts, rotas, NR-36 records and thermal break entries.

Role and payments

Employment record, contract, payslips, job description and departmental history.

Production and organisation

Targets, reports, messages, rotation, replacements and permitted recordings of the line.

Health and safety

ASOs, certificates, CAT, examinations, PGR, reports, ergonomics, EPI and training, where available.

Collective rules

Agreements and conventions for the occupational category and contractual period.

Integration contract

For integrated producers: the contract, statements, RIPI, CADEC and records of the civil relationship.

Transparency

What does not establish an entitlement by itself

The activity, sector or an isolated impression cannot replace assessment of facts and evidence.

  • NR-36 does not guarantee the same break total for every working day.
  • Thermal recovery and psychophysiological breaks are not automatically added together when simultaneous.
  • Working in meat processing does not alone prove unhealthy work or occupational disease.
  • Proper rural integration is a civil relationship; any employment relationship depends on facts beyond the statutory model.
  • Time and break records matter, but do not prevent comparison with actual practice.

Frequently asked questions

Questions before first contact

General answers for guidance. Conclusions depend on the records and circumstances of each contract.

Does NR-36 guarantee sixty minutes of breaks for every eight-hour working day?

Not in that form. NR-36 has a table linked to actual working time and rules on distribution. Depending on the working day, the total may reach sixty minutes. Cold-recovery and psychophysiological breaks are not automatically added together when they occur at the same time.

Can the company increase line speed because it introduced breaks?

NR-36 states that introducing breaks must not be accompanied by an increase in individual pace. Pace, targets, rotation and replacement arrangements must be examined in practice.

Can someone working outside a cold room have a thermal recovery break?

There may be an entitlement for continuous work in a similarly artificially cold environment under Súmula 438 of the TST. Temperature, continuity and climate zone need to be proved.

Is an integrated producer an employee of the meat processing company?

Integration organised under Lei nº 13.288/2016 is a civil relationship and does not by itself create employment between the integrator and integrated producer. Situations outside this model or involving possible sham arrangements require factual assessment and cannot receive an automatic answer.

Does shoulder or wrist pain prove an occupational disease?

No. Diagnosis, exposure, pace, repetition, medical history and causation require assessment. Examinations and ergonomic records may matter.

I was dismissed after an absence. Is there employment protection?

Lei nº 8.213/1991 provides employment protection in circumstances involving accidents or occupational disease. Benefits, diagnosis, causation and dates must be checked individually.
