Steelmaking in Vale do Aço: exposure, health and PPP records require consistent technical evidence

Coke ovens, blast furnaces, steelmaking, rolling, maintenance and laboratories do not involve the same exposure. Chemicals, heat, noise, medical records and social security documents must be assessed by department and period.

General legal information. Any entitlement depends on the facts, records, collective rules and, where applicable, expert evidence.

Carcinogenic agent

The benzene reference value does not represent safe exposure

NR-15 recognises benzene's carcinogenic nature and sets out specific prevention and health surveillance measures.

Annex 13-A of NR-15 classifies benzene as a proven carcinogen and states that no exposure is safe. For steelmaking, the standard sets a technological reference value to guide control measures, rather than a limit that removes the risk.

The department, emission source, tasks, duration, ventilation, environmental monitoring, respiratory protection and health surveillance must be examined for each period. A company name or job title does not replace this reconstruction.

Any unhealthy working conditions supplement, causal link to illness and recognition of hazardous work for social security purposes have different requirements. Reports and exposure history may inform each other but do not automatically produce the same outcome.

Situations we assess

Departments with potentially different exposures

Assessment is individual to the area, role, period and agent, including directly employed and outsourced workers.

  • Coke ovens and coal chemicals
  • Blast furnaces, steelmaking and casting
  • Rolling, galvanising and finishing
  • Mechanical, electrical and refractory maintenance
  • Laboratories, sampling and quality control
  • Utilities, gases, treatment and raw material handling
  • Industrial cleaning and contractors
  • Workers with inconsistent PPP records, absence from work or blood test abnormalities

Areas of assessment

Issues that may need checking

The list helps identify relevant issues, but cannot establish that a particular payment is due without examining the case.

Benzene

Sources, monitoring, health surveillance and Annex 13-A controls must be checked.

Other chemical agents

The product, composition, exposure route and NR-15 classification vary by process.

Heat and noise

Measurements, duration, protection and limits applicable to the period require technical assessment.

Occupational health

Diagnosis, exposure history, serial examinations and causation must be assessed by qualified professionals.

PPP and LTCAT

Role, department, agents, measurement method and responsible professionals must be consistent with environmental documents.

Qualifying hazardous work

Social security criteria vary by period and differ from the employment law supplement.

Working hours and shifts

Rotas, shift handovers, breaks and overtime may also form part of the assessment.

Outsourcing

Documents from the provider and plant may be needed to reconstruct the environment and responsibilities.

Would you like to organise your documents before deciding?

Initial advice identifies the facts, periods and records that need checking.

Employment time limits

The contract end date needs checking

As a general rule, the Brazilian Constitution allows two years after the contract ends to bring proceedings, and limits recovery to entitlements from the five years before the claim is filed.

2 years

General period from the end of employment for bringing an employment claim.

5 years

General reach of entitlements preceding the claim, subject to the particular circumstances.

In occupational illness cases, the dates of diagnosis, awareness of incapacity, absence and benefits may affect time limits. Preserve medical and employment documents.

Organising documents

What helps with assessment

You do not need every document at first contact. The aim is to identify what exists and what will need to be requested.

PPP, LTCAT and expert reports

Versions from the relevant period, responsible professionals, agents, measurements and stated methodology.

PGR and monitoring

Risk inventory, environmental assessments and control records, where available.

Occupational health

ASO occupational health certificates, serial examinations, medical certificates, CAT accident notifications, medical records and related benefits.

Role and department

Employment record book, contract, payslips, instructions, training and assignment history.

PPE and collective protection

Records, certificates, replacement, training and actual conditions of use.

Collective agreements

Agreements addressing supplements, health, shifts and conditions specific to the sector.

Transparency

What does not establish an entitlement by itself

The activity, sector or an isolated impression cannot replace assessment of facts and evidence.

  • Working in steelmaking does not automatically qualify for a supplement or hazardous service recognition.
  • The benzene reference value must not be used as a statement that exposure is safe.
  • Mention of benzene alone provides no basis for promising the highest rate of the unhealthy working conditions supplement.
  • A symptom or abnormal test result alone does not prove an occupational disease.
  • The employment law supplement and hazardous work recognition for social security purposes have different legal criteria.

Frequently asked questions

Questions before first contact

General answers for guidance. Conclusions depend on the records and circumstances of each contract.

Does every job in steelmaking qualify for an unhealthy working conditions supplement?

No. The department, agent, intensity or concentration, duration, protection and classification under NR-15 must be established. The industry alone does not determine entitlement to the Brazilian insalubridade supplement.

Is there a safe exposure limit for benzene?

Annex 13-A of NR-15 treats benzene as a proven carcinogen and states that there is no safe exposure. The technological reference value guides prevention and must not be interpreted as a limit that eliminates the risk.

Does benzene always qualify for the highest rate of the supplement?

It would be irresponsible to make that general claim. The supplement and its rate depend on the legal classification, activity, exposure and technical evidence applicable to the case, as well as any collective agreements.

Can a PPP containing incorrect information be corrected?

A correction may be requested where the data do not reflect the environment, role or agents. Expert reports, the PGR risk management programme, the LTCAT workplace conditions report and records from the period help support the correction.

Do unhealthy working conditions pay and special retirement use the same criteria?

No. Exposure evidence may be relevant to both, but employment and social security requirements are distinct and vary according to the period.

Does a health symptom prove a causal link to benzene?

No. Assessment requires a diagnosis, occupational history, medical monitoring and investigation of other causes. Clinical care must be provided by healthcare professionals.
